SEC V. Inteligentry, Ltd. et al. 2:13-cv-00344 (D. Nevada)


On February 28, 2013, the SEC filed a Complaint against John P. Rohner ("Rohner"), and the companies he controlled ("Company Defendants") for violations of the United States securities laws arising from their fraudulent sale of securities.  The Complaint alleged, inter alia, that Rohner and Company Defendants violated Sections 5(a) and (c), and 17(a) of the Securities Act of 1933, 15 U.S.C. §§ 77e(a), 77e(c), 77q(a); and Section 10(b) and Rule 10b-5 of the Securities Exchange Act of 1934, 15 U.S.C. § 78j(b), and 17 C.F.R. § 240.10b-5.

On March 7, 2013, the Court froze the defendants' assets, because the evidence of securities registration violations and fraud presented by the SEC demonstrated that the public interest in preserving the investment proceeds of the victims was greater than the defendants' burden resulting from an injunction.

On April 1, 2016, the Court granted Final Judgments against all defendants, ordering them to disgorge all proceeds received as a result of their fraudulent activity.

Distribution Agent

On May 18, 2015, the Court appointed Sally B. McMinimee of Prince, Yeates & Geldzahleras Receiver to marshal and preserve the assets of the defendants.  On September 13, 2016, the Court authorized the Receiver to develop a plan for the Court's approval to distribute the frozen assets to the investors.

Claims Process

If you wish to receive a payment from the Distribution Fund, please submit a signed Investment Verification Form and documentation that verifies your investment to the Receiver on or before May 5, 2017 at the below address.

  • Include the documentation that verifies your investment (such as cancelled checks, stock certificates and/or correspondence with defendants) with the Form.
  • You must file proof of claim postmarked on or before May 5, 2017 to the Receiver, Sally B. McMinimee at the below address. (If you do nothing, you will receive no payment).
