SEC v. Delano N. Sta.Ana, Case No. 06-80202-CIV-Middlebrooks (S.D. Fla., filed March 2, 2006)

On March 2, 2006, the Securities and Exchange Commission commenced proceedings to collect disgorgement, prejudgment interest and a penalty previously ordered in a settled public Commission administrative and cease-and-desist proceeding against Delano N. Sta.Ana. The complaint, filed pursuant to Section 21(e) of the Securities Exchange Act of 1934, Section 209(d) of the Investment Advisers Act of 1940, and Section 42(d) of the Investment Company Act of 1940, seeks a federal court order compelling Sta.Ana to pay the remaining $150,000 in disgorgement, prejudgment interest and penalty owed by him under the Commission's Order. The complaint charges that Sta.Ana failed to comply with the terms of the Commission's Order imposing remedial sanctions issued In the Matter of Lawrence S. Powell and Delano N. Sta.Ana, Administrative Proceeding File No. 3-11794 issued on January 11, 2005.
