Marijuana Container Businessmen Charged in a Conspiracy to Defraud

William Sears and Scott Dittman were charged by Information in the District of Colorado with conspiring to defraud the United States in connection with a scheme involving FusionPharm, a company involved in the development, manufacture, and sale of steel shipping containers retrofitted and refurbished for use as hydroponic growing pods for marijuana cultivation.

According to the Information, beginning as early as in or about March 25, 2011 and continuing at least through in or about May 15, 2014, the defendants conspired to defraud the United States and the United States Securities and Exchange Commission by obstructing the lawful governmental functions of the SEC. The conspiracy includes the offenses of securities fraud, through illegal stock sales; mail fraud; and wire fraud.

This case was prosecuted by Assistant United States Attorneys with the District of Colorado and by FWRO Staff Attorney Scott Mascianica, serving by designation in the District of Colorado as a Special Assistant United States Attorney.
