SEC Announces Dismissal of Civil Enforcement Action Against Gemini Trust Company, LLC

The Securities and Exchange Commission today filed a joint stipulation with Defendant Gemini Trust Company, LLC to dismiss, with prejudice, the Commission’s ongoing civil enforcement action against it.

As stated in the joint stipulation, the Commission’s decision to seek dismissal of this action is “in the exercise of its discretion,” and takes into account the “100 percent in-kind return of Gemini Earn investors’ crypto assets,” as well as state and regulatory settlements involving Gemini related to the Gemini Earn program. The Commission’s decision also “does not necessarily reflect the Commission’s position on any other case,” as stated in the joint stipulation.
