Washington, D.C. Dear Honorable Levitt: I am writing in opposition to SEC release Nos. 34-42099: IA-1845, "Certain Broker Dealers Deemed Not To Be Investment Advisers". I am supportive of the comments submitted by Mr. Duane Thompson, Director of Governmental Relations for the Financial Planning Association. It is my position that this rule if passed would further confuse an already confused consumer. I further believe this rule would undermine the true intent of the Investment Advisers Act of 1940 of protecting the public interest. As a Certified Financial Planner professional, I am appreciative of the efforts the SEC has taken to protect the consumer and it's guidance to the professionals who serve them.
