From: John Einberger [johnein@attglobal.net] Sent: Monday, July 08, 2002 11:28 AM To: rule-comments@sec.gov Subject: File No. S7-25-99 Gentleman: I encourage you to withdraw the proposed SEC rule "Certain Broker-Dealers Deemed Not to be Investment Advisors". The rule as proposed would allow brokers to perform financial planning tasks without being subject to the Investment Advisors Act of 1940. Your job is to protect the public from unscrupulous individuals and organizations who have their own interests in front of the clients. Since there is no clear line as to where investment advice ends and financial planning begging the rule should be withdrawn and possible redrafted. Thanks for your consideration John W. Einberger, CFP JohnEin@attglobal.net
