From: Dave Rusch [dave@tittmannrusch.com] Sent: Monday, June 24, 2002 6:54 PM To: rule-comments@sec.gov Subject: File No. S7-25-99 I am opposed to the proposed rule S7-25-99 - "Certain Broker-Dealers Deemed Not To Be Investment Advisors". Those of us who offer comprehensive financial planning advice adhere to the Investment Advisors Act of 1940 and so should everyone who wishes to provide similar services. The recent actions by some in the broker-dealer community tell me that the only logical SEC action should be to withdraw the proposed rule. The public has a right to have all who give advice operate under the same rules. David R. Rusch --
