In some sort of attempt to protect the investing public it seems like the NASD and SEC are trying to eliminate the professional Investment business.
Before you implement proposed new rules, give the investment community time to comment on how this will impact the business and the investing public in a negative way. The more government tries to help the worse it gets for everyone involved and this seems to be the case here. This could reduce the choices and opportunities for the average investor to seek advise from knowledgable professionals that have years of providing competent advise to clients.
