SEC NEWS DIGEST Issue 2003-201 October 22, 2003 COMMISSION ANNOUNCEMENTS SEC WEBSITE PROVIDES INFORMATION ON UPCOMING OUTREACH EVENTS CONCERNING HOMELAND SECURITY ISSUES FOR THE FINANCIAL SECTOR The Securities and Exchange Commission has added sections to existing pages on its Web site that provide information on homeland security related outreach events that will be held in various locations throughout the United States during the remainder of 2003 and 2004. These events are being sponsored jointly by the interagency working group known as the Financial and Banking Information Infrastructure Committee (FBIIC) and the Federal Deposit Insurance Corporation (FDIC). FBIIC is chartered by the President's Working Group on Financial Markets, serves as the Homeland Security Council Financial Markets Work Group, and is charged with improving coordination and communication among financial regulators and enhancing the reliability of the U.S. financial system. Each outreach event will take the form of a full day symposium that will examine the security of the U.S. financial sector and outline steps that the banking, securities, and insurance industries can take to protect themselves. These events will provide opportunities to hear from senior government, law enforcement, and private sector leaders about initiatives that have already been undertaken to improve the security and the resiliency of the financial sector. Speakers will help participants to identify actions and plans that financial institutions should take to prepare for an emergency. (Press Rel. 2003-139) ENFORCEMENT PROCEEDINGS COURT IMPOSES 71 MONTH SENTENCE FOR VIOLATING A COMMISSION ASSET FREEZE On October 1, Judge Stephen P. Friot, U.S. District Judge for the Western District of Oklahoma, sentenced John E. Collins to a term of 71 months in federal prison, plus three years supervised release, and ordered him to pay $290,000 in restitution in connection with his obstructing an SEC investigation and willful violation of a court ordered asset freeze. Collins previously entered into a plea agreement with the U.S. Attorney for the Western District of Oklahoma pursuant to which he pleaded guilty to one count of obstruction of justice and one count of wire fraud. These violations are the subject of the Commission's civil contempt proceedings against Collins in the Western District of Oklahoma. In its contempt action, the Commission alleged that Collins had willfully violated the terms of an asset freeze order entered against Garry W. Stroud and aided and abetted Stroud in violating the terms of the asset freeze order. On Nov. 18, 2002, Judge Lee R. West, U.S. District Judge for the Western District of Oklahoma, found Collins in civil contempt and ordered him to turn over $187,000 in property obtained from Stroud both before and after the entry of the asset freeze order. In response to Judge West's order to turn over funds and property to the receiver in the Stroud case, Collins faxed to the receiver's office a bogus promissory note allegedly signed by a third- party agreeing to pay the money due under the contempt order. Simultaneously with his efforts to deceive the receiver, Collins raised an additional $100,000 from other victims in a separate scheme. As a consequence of the bogus promissory note, and his failure to comply with the contempt order, Judge West ordered Collins incarcerated to coerce his compliance. At the time of his incarceration, the FBI swore out a criminal complaint against Collins, which ultimately led to his plea. [U.S. v. John E. The announcement should have read as follows: CHIEF ACCOUNTANT IS SEEKING CANDIDATES FOR FOUR PROFESSIONAL ACCOUNTING FELLOW POSITIONS The Securities and Exchange Commission's Office of the Chief Accountant announced that it is now accepting applications for Professional Accounting Fellow (PAF) positions in the Office of the Chief Accountant. The PAF program, which began in 1972, is designed to provide participating fellows with outstanding opportunities for public service to investors, personal development, and career advancement. During their fellowship, the successful candidates will work directly with the Chief Accountant, be involved in the study and development of rule proposals under the federal securities laws, liaison with professional accounting standard-setting bodies, and consult with registrants on accounting and reporting matters. For the four positions that are open, the Office of the Chief Accountant would like to select one candidate with significant experience in general accounting topics such as revenue recognition, compensation and business combinations, one candidate with significant experience in accounting for financial instruments, one candidate with significant experience in designing and performing audit procedures, and a fourth candidate with any of these specialties.
