AdvisorOne Funds and CLS Investments, LLC

A notice has been issued giving interested persons until September 25 to request a hearing on an application filed by AdvisorOne Funds and CLS Investments, LLC for an order exempting them from Section 15(a) of the Investment Company Act and Rule 18f-2 under the Act. The order would permit the applicants to enter into and materially amend subadvisory agreements without shareholder approval. (Rel. IC-28894 - August 31)

Approval of Proposed Rule Change

The Commission granted approval of a proposed rule change (SR-BATS-2009-026), as modified by Amendment No. 1 thereto, submitted by the BATS Exchange to amend BATS Fee Schedule to impose fees for ports used for order entry and receipt of market data. Immediate Effectiveness of Proposed Rule Change

A proposed rule change filed by NASDAQ OMX PHLX relating to Standard and Poor's Depository Receipts/SPDRs (SPY) equity options (SR-Phlx-2009-73) has become effective pursuant to Section 19(b)(3)(A) of the Securities Exchange Act of 1934.
