Michelle P. Suppes and Mark Anthony (U.S.D.C.-S.D.N.Y.) 97 Civ. 2376 (RPP) The Securities and Exchange Commission ("Commission") announced the filing today of a complaint in the United States District Court for the Southern District of New York against Michelle P. Suppes and Mark Anthony. The Commission's complaint charges the defendants with violating a prior order of the Commission which barred both Suppes and Anthony from associating with, among others, any broker or dealer, and seeks an order preliminarily and permanently enjoining Suppes and Anthony from violating the bar order and commanding them to comply with the bar order. In addition, the Commission's application for an order temporarily restraining Suppes and Anthony from continuing to violate the bar order pending the outcome of a hearing on the Commission's request for a preliminary injunction was granted. On January 15, 1997, the Commission instituted and simultaneously settled an administrative proceeding against Suppes and Anthony in which both consented to the issuance of an Order Instituting Proceedings Pursuant To Sections 15(b)(6) And 19(h) Of The Securities Exchange Act Of 1934, Making Findings, and Imposing Remedial Sanctions ("Commission Order"). The Commission Order arose out of permanent injunctions on consent entered against them in a prior litigation, SEC v. Sarivola, 95 Civ. 9270 (RPP). The Commission Order bars Suppes from association with any broker, dealer, municipal securities dealer, investment adviser or investment company, and provides that Suppes may reapply for association after two years. The Commission Order permanently bars Anthony from association with any broker, dealer, municipal securities dealer, investment adviser or investment company and from participating in any offering of penny stock. At the time the Commission Order was issued, Suppes and Anthony were associated with Suppes Securities, Inc., a registered broker-dealer. The Commission's Complaint alleges that Suppes and Anthony have continued their association with Suppes Securities in violation of the Commission Order. Among other things, Suppes and Anthony have both conducted firm business on the premises of Suppes Securities, involved themselves in financial and personnel decisions for the firm, and Suppes has exercised control over certain firm books and records.
