From: Gerald Browne [billetdoux@cox.net] Sent: Friday, November 28, 2003 1:28 PM To: rule-comments@sec.gov Subject: file No.S7-23-03 Sirs: The decision to exclude smaller stocks from your consideration of naked short selling is not only unfair to the investors in such stocks, but obviously tantamount to surrendering to the influence of those guilty of such thievery. It appears that the SEC is fearful of the large firms involved and is willing to disregard the millions of dollars those firms have criminally bilked through these illicit practices, therefore allowing them to continue. What must happen before the SEC stops its discriminating decisions? Unless you can act fairly on this naked shorting issue... ...shame on you! Gerald A. Browne Oceanside, California
