Subject: File No. S7-16-98 Rule 102(e) Comments Date: 8/17/98 8:27 AM Dear Secretary Katz: I was recently made aware of the current effort to amend the above referenced rule in governing the conduct of accountants and other professional's before the SEC. In reading the data provided concerning the proposed changes, it is agreed that sanctions should be issued in cases where the integrity of the financial reporting system is compromised, or it is evident that the acccountant or other professional has intentionally disregarded established reporting guidelines. I, however, hope that the SEC would establish firm guidelines in defining what "improper professional conduct" to not include an isolated incident of misjudgment or error in judgement, but rather an established disregard for professional standards, and intentional violation of reporting requirements which has resulted in a misstatement of financials.
