ORDER SCHEDULING HEARING AND DESIGNATING PRESIDING JUDGE |
The Securities and Exchange Commission (Commission) issued its Notice and Order for a Hearing Pursuant to Section 19 of the Public Utility Holding Company Act of 1935 on August 30, 2004 (Notice). The Notice was issued pursuant to an Order of Remand from the United States Court of Appeals for the District of Columbia dated January 18, 2002.
The hearing, scheduled to commence at 9:30 a.m., Monday, October 4, 2004, in the Commission Headquarters, Hearing Room 1C50, 450 5th Street, N.W., Washington, D.C., is hereby postponed. An in-person prehearing conference will be held at the same time and place.
Prior to the prehearing conference the parties shall confer and agree on a date for the hearing. It is expected that the agreed date will be at the earliest possible time. The parties shall also agree on a schedule for all prehearing exchanges of materials intended to be offered to supplement the record, including the testimony of experts, if any. Any motions to intervene must comply with Rule 210 of the Commission's Rules of Practice, 17 C.F.R. § 201.210.
