I am a sharelder at McCausland Keen Buckman, a law firm that represents individuals and institutions with disputes against the securities industry. I frequently resort to the arbitration services of FINRA Dispute Resolution during the course of my practice. I am currently on the board of directors of the Public Investors Arbitration Bar Association and serve on FINRA's National Arbitration and Mediation Committee.
I support the proposed important amendments to the Discovery Guide, which will encourage the exchange of relevant, usable discovery, necessary to assure a full and fair adjudication of customer disputes. These changes clairfy the need that e-discovery be readily usable and that, in product cases, documents relating to the creation,testing, monitoring and sale of structured products are clearly within the scope of discovery.
