The CFTC is unable or unwilling to regulate Total Return Swaps. Retail demands full transparency on all positions including counterparties. This is a gray area that circumvents normal regulatory reporting.

The stock market is a jungle of derivatives less regulated than a Las Vegas casino. Swaps are a way of of hiding trades, no different than ATS dark pool abuse.

Retail has discovered Direct Registration of Shares and Pandoras box is wide open. The SEC should promptly rid itself of Hester Pierce, a paid malevolent actor for short hedge funds.
