1) How can you expect a retailer to file a detailed complaint when retail is kept in the dark:

Please ensure that swap data is publicly reported so that swap positions aren't used to hide trading activity which would otherwise be regulated.

2) It would appear that \"Equity Total Return Swaps\", hedged by deep out-of-the-money put options, can be used to hide short interest in some stocks. Notable by the fact that these positions present cyclical movements every three months, and stock price movements are highly correlated to each-other.

Overlooking such a loophole allows shorting to bypass normal stock-shorting regulations.
