The ability to invest in a leveraged fund is an extension of living in a free society. I do not need the SEC to evaluate my capability to competently determine what is and what is not an appropriate investment for my portfolio.

This proposed rule creates a slippery slope towards paternalistic restrictions aimed at reducing risk, such as limits on investing in companies that are deemed to be overvalued or limits on investing in companies with high levels of debt.
