I have been trading LI Funds for a couple of years now. I monitor my investments on a near daily basis. I use weekly scans to see which ETFs are at the top and adjust holdings accordingly. I don't think the SEC should be deciding whether or not the public is smart enough to evaluate the risk of investing in LI funds.
