The proposed regulation is an extreme overreach and not in the spirit of capitalism. While I understand you concerns, given these funds dissolve over time and can be very volatile, all that is required is education to the investor while they make the trade. I already had to read the risks and sign a separate agreement with my own brokerage house to trade these funds and that was sufficient. To deny me, a personal investor, the ability to hedge my own portfolio places me at a disadvantage to large firms and forces me to pay hefty commissions to wealth managers to manage my money. perhaps this is the intent of your proposal?

We have enough laws and regulations. Let people make their own informed decisions, just as we allow them to do in their healthcare. If we start banning access to everything that could go wrong, we're sliding down the slippery slope of government control over everything and become China. I don't want to live in that type of country. Do you?
