In my opinion, investors should always perform due diligence prior to investing in a stock or fund. The investor ultimately owns the responsibility of a gain or loss in their portfolio. I don't believe that a governmental agency should intervene in determining whether or not a leveraged ETF is appropriate for a potential investor to consider. Furthermore, I don't believe that a governmental agency should restrict a leveraged ETF from being made available to investors. By taking such a stance in the interest of the minority of people who don't take the time to evaluate what they're potentially investing in, it penalizes the majority of people who see the leveraged ETF as an appropriate investment vehicle.
