While this docket focuses on the definition of foreign private issuers, I want to raise a related concern that affects investor trust and market integrity: the lack of restitution pathways for victims of cryptocurrency scams. I am a victim of a 2025 crypto scam that wiped out my life savings. Despite tracing the funds and identifying laundering wallets, I was told I had no legal standing to recover anything - because the funds didn't pass through a directly linked wallet. This outdated standard of proof leaves victims without recourse and allows criminal networks to exploit regulatory gaps. I urge the SEC to consider: - Supporting reforms to 28 CFR § 9.8 to allow restitution from any criminally linked wallet - Advocating for investor alerts and scam warnings across digital platforms - Collaborating with DOJ and FTC to modernize restitution standards for digital asset fraud Investor protection must evolve with the technologies that enable abuse.
