In light of the news that Jina Choi, Head of the SEC's SF Office, has stepped down. I would like to reiterate my concerns that the delays in processing Whistleblower claims inappropriately prejudice a Whistleblowers right to due process and fair adjudication.
As in my situation, I had substantial communication with Jina Choi and the SEC's SF Office. However, now that Jina Choi and some of her staff have left, how will the SEC act to preserve a record of my Whistleblower assistance and actions for the purpose of adjudicating my claims?
If Jina Choi is not an SEC employee, will the SEC be able to seek information and 'testimony' from Jina Choi for review by the Claims Review Staff?
I am very concerned that the continued delays in processing Whistleblower claims will only cause this problem to expand exponentially.
The current backlog which has been calculated to be between 5 and 20 years would mean it is unlikely the the enforcement staff involved in a case would still be working for the SEC by the time a preliminary determination is issued.
