Dear Gentlemen,
I would like to know the status of this proposed rule. When will it take effect? I need to know because a company I own shares in, Alesco Financial Inc., has been for many months aggressively naked short sold. According to your own statistics, the median failures to deliver during the first quarter of 2008 for Alesco has been over 600,000 shares. The naked short sellers will soon reach their goal of forcing Alesco stock to $0 before the anti-fraud rule goes into effect.
Could you please release publicly the names of those who have a failure to deliver of 10,000 shares or more of Alesco stock? You must know who they are, and it makes no sense to shield the guilty at the expense of the innocent.
