As an SEC SOX/Dodd Frank whistleblower, I appreciate the Commission's initiative to improve whistleblower protections and remedies. I fully support the SEC's proposal on two amendments to Exchange Act Rules 21F-3 and 6, the rules governing its whistleblower program:
1) The first proposed amendment addresses instances when a whistleblower from the
SECs program receives an award from another, non-SEC, whistleblower program. I fully support this amendment.
2) The second affirms the Commissions authority to consider the dollar amount of a
potential award for the limited purpose of increasing an award, but not to lower an
award. I fully support this amendment.
I also fully endorse the comments and recommendations submitted by KOHN, KOHN COLAPINTO, LLP in their letter dated March 22, 2022, with a corrected version submitted on March 28, 2022. Whistleblowers are fortunate to have their support and expertise.
