The time requirement for filing should depend, NOT on the 1st advertisement, or Email, or tweet, or smoke signal, but on the first hard commitment (or: signed check) made by any investor.
This will let a start up talk freely January 1 (and on), file papers March 1 -- and then get papers signed April 1 and on.
