Item 8.01 Other Events.
On October 5, 2010, the Corporation received an imminent danger order issued by the Mine Safety and Health Administration under section 107(a) of the Federal Mine Safety and Health Act of 1977 at its Clarks quarry in New Bern, North Carolina. The order was issued when an oil disposal vender was observed on top of the tank of the truck owned by the vending company. Railings were not provided and fall protection/prevention was not being utilized. Fall protection was subsequently provided and utilized by the vender and the citation was then terminated.
