Item 8.01.  Other Events

Zynex, Inc. has announced earlier a claim of Anthem Blue Cross and Blue Shield (“Anthem”) regarding payments for certain medical devices.  As previously indicated, Zynex continues to provide its products to Anthem insureds, including products which may be used to treat the insureds with the same medical conditions as those using devices subject to the claim.

Marquette Healthcare Finance, the lender under a line credit with Zynex, has been informed of the claim.  Marquette has indicated that it is taking no action at this time.

As a result of notifying Anthem that it will appeal the claim to a higher authority at Anthem, Anthem and Zynex have commenced negotiations regarding the amount of the claim.
