Item 1.04 Mine Safety.

On October 19, 2023, Vulcan Construction Materials, LLC, a subsidiary of Vulcan Materials Company (the “Company”), received an imminent danger order issued by the Mine Safety and Health Administration under section 107(a) of the Federal Mine Safety and Health Act of 1977 at its Bartlett Underground Quarry in Bartlett, Illinois.  The order was issued to remove a customer truck driver observed in the bed of his truck without fall protection while attempting to level the load of aggregate material.  No injuries occurred and the Company took corrective action with respect to the incident.
