The settlement of this matter, which is unrelated to NYSE Euronext’s role as an issuer of securities, does not involve the payment of cash to any party or counsel. </div> <div align="left" style="font-size: 10pt; margin-top: 6pt">In addition to the matter described above and in the 2009 Form 10-K, NYSE Euronext is from time to time involved in various legal proceedings that arise in the ordinary course of its business.
