9. Income Taxes

The Company is subject to income tax in the United States as well as other tax jurisdictions in which it conducts business. Earnings from non-U.S. activities are subject to local country income tax. The Company does not provide for federal income taxes on the undistributed earnings of its foreign subsidiaries as such earnings are to be reinvested indefinitely. For the three months ended March 31, 2017 and 2016, the Company recorded income tax expense of $1.0 million and an income tax benefit $0.1 million respectively. The income tax expense for the three months ended March 31, 2017, was primarily attributable to foreign and state income taxes including tax effects of the gain related to the sale of the Skyfence business, offset in part by an intraperiod tax benefit allocation related to unrealized gains reported in other comprehensive income. Additionally, the amount of unrecognized tax benefits increased during the three months ended March 31, 2017, which also contributed to the income tax expense for the period. The income tax benefit for the three months ended March 31, 2016 was primarily attributable to an intraperiod tax expense allocation related to unrealized gains reported in other comprehensive income, offset in part, by foreign and state income taxes.

Factors that impact the income tax provision include, but are not limited to, stock-based compensation expense, permanent tax adjustments, foreign operations and a valuation allowance against the Company’s domestic deferred tax assets.
