International Trade Commission Final Decision
On September 24, 2012, Avago Technologies Fiber (IP) Singapore Pte. Ltd., Avago Technologies General IP (Singapore) Pte. Ltd. and Avago Technologies U.S. Inc. (collectively, Avago) filed a complaint against Mellanox Technologies, Ltd. (the Company), Mellanox Technologies, Inc., IPtronics A/S, IPtronics, Inc., FCI USA, LLC, FCI Deutschland GmbH and FCI SA (collectively, Respondents) with the United States International Trade Commission (Inv. No. 337-TA-860) (the ITC), alleging that the Respondents engaged in unfair acts in violation of Section 337 of the Tariff Act of 1930, as amended, through allegedly unlicensed importation, sale for importation and/or sale after importation of products covered by patents asserted by Avago.
On December 13, 2013, with regard to the patents asserted against the Company, in a final initial determination (the ID), the Administrative Law Judge found that the Companys production and sale of its Active Cable Products do not infringe Avagos U.S. Patent Number 5,596,456 (the 456 Patent), but did find that certain Company products that contain a particular type of vertical cavity surface emitting laser, a component that is supplied to the Company by third parties, do infringe on U.S. Patent No. 5,596,595 (the 595 Patent).
On April 17, 2014, upon review of the ID in part, the ITC issued a final decision affirming the Administrative Law Judges rulings, and issued a limited exclusion order and cease and desist orders (the Remedial Orders) directed to Respondents products that infringe the asserted claims of the 595 Patent.
The final decision of the ITC becomes effective following a 60-day Presidential review. During the Presidential review period, the ITC has required Respondents to post a bond in the amount of 3 percent of the entered value of the products covered by the Remedial Orders.
The Remedial Orders are not currently expected to impact the Companys current or planned product offerings or have a material adverse effect on the Companys business, financial position, results of operations or cash flow.
Additionally, on April 21, 2014, the Company issued a press release announcing the ITCs final decision, which is attached as Exhibit 99.1 to this Current Report on Form 8-K and is incorporated herein by reference.

ITC RULES MELLANOX DOES NOT INFRINGE AVAGOS LASER DRIVER PATENT
ITC Determines 456 Patent Asserted by Avago Not Infringed
SUNNYVALE, CA. and YOKNEAM, ISRAEL April 21, 2014 Mellanox® Technologies, Ltd. (NASDAQ: MLNX), a leading supplier of high-performance, end-to-end interconnect solutions for data center services and storage systems, announced today that, on April 17, 2014, the U.S. International Trade commission (ITC) issued its Final Determination ruling that Mellanoxs Active Optical Cable products and VCSEL drivers do not infringe Avagos U.S. Patent Number 5,596,456, directed to a laser driver, which was asserted against Mellanox by Avago in an ITC complaint (Inv. No. 337-TA-860) filed in September 2012.
We are happy with the ITCs ruling, which confirms our position that Mellanox and IPtronics do not infringe the key patent at issue in the case, said Eyal Waldman, president and CEO of Mellanox Technologies. Our customers can expect to continue receiving the same quality products that they have relied upon historically from Mellanox.
The ITC also affirmed the ALJ ruling that certain Mellanox cable products that contain a particular type of vertical cavity surface emitting laser (VCSEL) do infringe another of Avagos patents, US Patent No. 5,596,595, directed to a VCSEL and issued a limited exclusion order and cease and desist orders with respect to those products. The VCSELs in the products at issue are supplied to Mellanox by third parties.
These orders, however, will not interrupt Mellanoxs ability to supply cables or otherwise impact Mellanoxs current or planned product offerings. Those orders are also not expected to have a material adverse effect on the companys business, financial position, results of operations or cash flow.
