Pursuant to a domestic relations order dated 4/2/2009, the reporting person no longer reports as beneficially owned these securities, which are owned by his ex-wife. These securities expired pursuant to their terms and were never exercised. On February 26, 2010, upon reclassification of the issuer's Series A Convertible Preferred Stock, the expiration date of all warrants issued in conjunction with the issuer's convertible notes was changed to March 1, 2013 and, to the extent the exercise price was greater than $0.65, the exercise price was lowered to that amount. /s/ John E.
