Shares granted that expire, terminate or are forfeited are then available for reissuance as future grants. At June&amp;#160;30, 2013, there were approximately 137,000 shares available for future grants under the 2004 Plan.&lt;/font&gt;&lt;/p&gt;

&lt;p style="MARGIN: 0in 0in 0pt;"&gt;&lt;font style="FONT-FAMILY: Times New Roman; FONT-SIZE: 10pt;" size="2"&gt;During the six months ended June&amp;#160;30, 2013, we granted 527,600 restricted stock awards at a weighted-average grant date price of $12.90 per share of which 330,000 shares will vest upon certification by the compensation committee of the company&amp;#8217;s board of directors of the achievement of certain company financial performance criteria for the calendar year ending December&amp;#160;31, 2013 and 164,100 shares vested upon issuance.&amp;#160; The remaining 33,500 restricted stock awards vest one year from the grant date. As of June&amp;#160;30, 2013 we have assessed the likelihood that the performance condition will be met and have recorded the related expense based on the estimated outcome.&lt;/font&gt;&lt;/p&gt;
