In our opinion Year 2000 reporting to the SEC should be confined to clearing firms and not introducing brokers. It is the clearing firms that process trades, issue statments and confirmations. The correspondent is reliant upon the systems of the clearing firm. All an introducing broker could say about Year 2000 problems in a disclosure to the SEC would be that, in the opinion of the introducing firm, the clearing firm is or intends to be compliant. This would be a meaningless statement not verifiable by the correspondent. The SEC would be correct in charging clearing firms with responsibility for Year 2000 issues.
