As a private investor I consider limited access
"Analyst Conference Calls" as legitimate as the
actions that sent Michael Milliken to jail.
The proposed rule says you cna profit from inside
information (resell it as "research") if the size of
the circle is big enough.
Any rule concerning business forecsts should require a
filing with the SEC prior to any other public
disclosure. The filing should be available online by
8:00 AM eastern time on the day of the disclosure.

I feel the general public has a right to this information. This information s
hould not be accessible to only stock brokers and analysts. The individual
investor is competent enough to understand and utilize information in making
their own investment decisions contrary to what insiders might think. To

I think the playing field should be leveled. Why should large wall street
firms receive an unfair advantage over the individual investor. Such an
advantage flys in the face of the foundations of full disclosure required of
public companies. This regulation will proctect the public from the "Street"
avarious behavior. This is the type of government regulation that makes
sense and is in the interest of everyone who invests as an individual
investor especially since a lot of individual investors have their
retirement funds in the market.

As an investor, I am appalled by the current rules that allow companies
selectively to release material information to Wall Street analysts without
simultaneously releasing the news to the public at large, and more
importantly, without releasing that information to me, an owner. The current
rules have literally cost me money because a select group of Wall Street
insiders have been granted access to material information and have acted on
that information before I was provided the same information. It should be
mandatory for all releases of material information to be to the public at
large. Some forward-looking companies already provide open disclosure. Now
it's time to require all companies fairly to disclose material information.

I am completely in favor of this legislation. To allow companies to provide
information to analysts and other groups that may not even be stockholders
seems to foster some level of insider trading. It certainly puts the
existing stockholder at a disadvantage that should not exist. There is a
legal liability of the company to its stockholders; there isn't such a
liability to analysts.

I see no reason to offer preferential treatment to a select group of
