I would like to comment on the consideration of this rule. While I have only been in the industry for a few years I have already became aware of the burden of record keeping, information needed for client, and SEC rules and regulations which while does help protect the public from devious agents puts an undue strain on keeping up with everything required. When I read about this particular rule I thought to myself this will be just another piece of information the vast majority of my clients could care less about. I pride myself in following all the rules and keeping my clients interest as my number one priority, however, they are bombarded with so much information the common person is overwhelmed by it all. I hope you would take into consideration the question; Will this information truly help the client make an informed decision on how he or she should invest, or will it just add to the confusion? The fees on a product is already included in the prospectus and has little to do with the fact of a certain investment will or won’t perform well.

In conclusion I would urge NASD to withdraw the rule.
