ENFORCEMENT PROCEEDINGS
IN THE MATTER OF NEXT FINANCIAL GROUP, INC.
On August 24, the Commission issued an Order Instituting
Administrative and Cease-and-Desist Proceedings Pursuant to Sections
15(b) and 21C of the Securities Exchange Act of 1934 (Order) against
NEXT Financial Group, Inc. (NEXT).
The Order alleges that NEXT, a registered broker-dealer headquartered
in Houston, Texas, willfully violated Regulation S-P by disclosing
nonpublic personal information about its customers to nonaffiliated
third parties, without allowing the customer the opportunity to opt
out of such disclosure, by allowing registered representatives to take
customer nonpublic personal information with them when leaving NEXT's
employment. The Order also alleges that NEXT willfully aided and
abetted and caused other broker-dealers' violations of Regulation S-P
by encouraging, and in many cases facilitating newly employed
registered representatives to bring their customers' personal
nonpublic information, such as social security numbers, account
numbers, passport numbers, drivers license numbers, dates of birth and
customer financial information, to NEXT without proper notice to the
customer and a reasonable opportunity to opt out of such disclosure.
A hearing will be scheduled before an administrative law judge to
determine whether the allegations contained in the Order are true, to
provide NEXT an opportunity to respond to these allegations, and to
determine what sanctions, if any, are appropriate and in the public
interest. The Order directs the administrative law judge to issue an
initial decision within 300 days from the date of service of the Order

SEC BRINGS EMERGENCY ACTION IN CONNECTION WITH FRAUDULENT INDEX OPTION
TRADING SCHEME
On August 23, the Commission filed an emergency civil action against
Charles O. Morgan, Jr., as personal representative of the Estate of
Frederick J. Kunen (Kunen's Estate), in connection with a fraudulent
options trading scheme orchestrated by Frederick J. Kunen (Kunen).
Kunen died on July 11, 2007, at age 55, and resided in Coconut Creek,
Florida. On August 23, the Honorable Alan S. Gold, United States
District Judge for the Southern District of Florida entered, among
other things, an emergency order temporarily freezing the assets of
Kunen's Estate.
The Commission's complaint (Complaint) alleges that from at least
January 2007 until his death on July 11, 2007, Kunen raised over $2
million through a fraudulent index options trading program. The
Complaint further alleges that Kunen falsely represented to investors
that they were guaranteed a 10-20%, risk-free monthly return on their
investment, that their principal was safe, and that the index options
trading program had a successful eight-year track record. The
Complaint also alleges that Kunen effected transactions in individual
investors' accounts once the investors had funded the accounts, and
after effecting the trades, Kunen falsely told investors that the
trading had resulted in profits and instructed investor to send him
his portion of the profits. Finally, the Complaint alleges that Kunen
received approximately $1 million in fraudulently obtained
compensation from investors and that none of the investors' accounts
show profits from Kunen's trading.
The Court appointed Scott M. Dimond, an attorney in the law firm of
Dimond Kaplan & Rothstein P.A., as Receiver over Kunen's Estate. Among
other things, Mr. Dimond is responsible for marshaling and
safeguarding assets held by Kunen's Estate.
The Complaint charges Kunen with violating Section 17(a) of the
Securities Act of 1933 and Section 10(b) of the Securities Exchange
Act of 1934 and Rule 10b-5 thereunder. The SEC is also seeking, among
other things, disgorgement of ill-gotten profits against and an
accounting from Kunen's Estate. [SEC v. Charles O. Morgan, Jr., as

SEC v. BRIAN N. HOLLNAGEL AND BCI AIRCRAFT LEASING, INC.
On August 22, after a two-day evidentiary hearing, the Honorable
Elaine E. Bucklo of the United States District Court for the Northern
District of Illinois issued a preliminary injunction against Brian N.
Hollnagel (Hollnagel) and BCI Aircraft Leasing, Inc. (BCI), enjoining
Hollnagel and BCI from further violations of the antifraud provisions
of the federal securities laws, in addition to other relief.
Previously, on Aug. 13, 2007, the Commission filed a civil injunctive
complaint alleging that Hollnagel and BCI, from 1999 through 2006,
raised at least $82 million from approximately 120 investors through
the fraudulent offer and sale of membership shares of Limited
Liability Corporations (LLCs) controlled and managed by BCI. According
to the complaint, Hollnagel, a resident of Chicago, Illinois, and BCI,
headquartered in Chicago, Illinois, told investors that they would use
investor funds to purchase specifically identified commercial aircraft
for the LLCs and, in turn, lease the aircraft to commercial airlines.
According to the complaint, investors were told they would receive
part of the lease revenue from the particular aircraft, in the form of
regular monthly payments, as their return. The complaint further
alleged that the Defendants also told investors that if an aircraft
owned by an LLC was sold, investors were entitled to half of all
proceeds from the sale above and beyond their capital contribution. In
reality, according to the complaint, Defendants operated a massive
Ponzi scheme. In addition, the complaint alleged that, in 2007,
Defendants continued their scheme by fraudulently repurchasing
investors' interests through materially misleading statements.
Finally, the complaint alleges that, as a result of their conduct,
Hollnagel and BCI violated Section 17(a) of the Securities Act of 1933
and Section 10(b) of the Securities and Exchange Act of 1934 and Rule
10b-5 promulgated thereunder.
In its Memorandum and Order, the Court found that the Commission had
satisfied its burden of proof and was entitled to a preliminary
injunction. The Court further found, among other things:
* "It is undisputed that BCI made material representations in its
LLC offering documents that the investors were buying shares in an
LLC that would purchase a specific aircraft that in many cases were
not true."
* "There can be no doubt that BCI and Hollnagel acted with
scienter."
As a result, the Court issued a preliminary injunction against
Hollnagel and BCI enjoining them from further violations of Section
17(a) of the Securities Act and Section 10(b) of the Exchange Act and
Rule 10b-5 thereunder. The Court declined, however, to grant the
Commission's request for an asset freeze or the appointment of a
receiver at this time to give BCI and Hollnagel the opportunity to
fulfill their promise to pay investors within 60 days the $48 million
that is due to them. The Court further provided that, among other
things:
* If BCI does not repay the investors within 60 days, or for any
other reason it becomes apparent before that time that BCI will not
be able to pay the investors, the Court will reconsider the
Commission's request for a freeze of assets and appointment of
receiver; and
* BCI must provide certain reports to the Commission on a weekly
basis and must provide notice to the Commission prior to any
significant withdrawals (in excess of $20,000). [SEC v. Brian N.

COMMISSION OBTAINS TEMPORARY RESTRAINING ORDER, ASSET FREEZE AND
APPOINTMENT OF A RECEIVER IN ALLEGED $25 MILLION PONZI SCHEME
On August 24, the U.S. District Court for the Eastern District of
California granted the SEC's request and issued an order temporarily
prohibiting the further sales of investments by defendants, freezing
assets, and appointing Michael J. Quilling to take control of the
assets and operations of Secure Investment Services, Inc., American
Financial Services, Inc. and the Lyndon Group, Inc., as a temporary
receiver. The court set the matter for further hearing on a
preliminary injunction on Sept. 21, 2007.
According to its complaint, the Commission alleges that Donald Neuhaus
of Redding, Calif., his daughter Kimberley Snowden, and their company
Secure Investment Services, Inc., orchestrated the Ponzi scheme that
falsely promised safe, secure and profitable interests in life
insurance policies known as "viaticals" while failing to disclose the
dire financial condition of the investment venture. Many of the
investors were elderly and invested their retirement savings. The
Commission also alleges Neuhaus and Snowden pocketed $700,000 for
their personal use while the scam was on the verge of collapse.
According to the Commission's complaint, Neuhaus and Snowden sold
shares of life insurance policies, calling them "bonded life
settlements." They persuaded investors to buy the securities by
representing that their money would be used to purchase and pay the
necessary premiums on the life insurance policies. They promised
returns up to 125 percent when the person insured by the policy died.
The Commission's complaint alleges that Neuhaus and Snowden instead
used investors' money for their own personal use and to cover the
premiums on other insurance policies owned by other groups of
investors. Their conduct constituted a Ponzi scheme in which every new
investor was being defrauded to provide the cash needed to conceal the
misrepresentations to an earlier group of investors. They failed to
inform investors that the enterprise was on the brink of collapse, and
that investors risked losing everything if life insurance policies
expired due to lack of payment.
The Commission further alleges that Neuhaus and Snowden misled
investors by providing them with life expectancy estimates supposedly
certified by a physician who was, in reality, a convicted felon
falsely holding himself out as a physician. They falsely claimed that
the investments were protected by bonding companies. But these were,
in fact, unlicensed overseas firms with no assurance of actually
repaying investors.
The Commission continues to seek preliminary and permanent
injunctions, return of ill-gotten gains with prejudgment interest, and
penalties against all defendants.
