With respect to notifying other agencies prior to the SEC, the proposed rules indicate that the date of that notification shall be considered as the date of submission to the SEC with respect to receiving an award.

Without clarification any contact with any other state or federal agency regarding the complaint before enactment of the legislation would seem to be a bar to the receiving the award.

The result would likely be that certain potential tips might not be made if another agency had been contacted before enactment of the legislation and defeat the purpose of encouraging tips being offered to the SEC.
