I am VERY opposed to this rule. This will be horrible for investors and add massive bureaucracy and regulations investments that I use on a regular basis. You have not shown there is a problem that actually needs to be solved here. Why should these funds be treated differently. This goes against the traditional rules for all other securities, and will set a horrible and dangerous precedent. Leveraged and inverse funds are very import to me and all me to seek enhanced returns to protect my portfolio. I am more than capable of understanding them and the risks. You have no right to arbitrarily tell me not to use them or and act as a nanny state.
