I think as long as there are any failure to deliver problems in a stock, that stock should no longer be able to be shorted. I also think the uptick rule should be reestablished at something like a 25 cent uptick before the stock can be shorted again, this may help control program trading. Uncontrolled shorting is destroying the companies ability to obtain capital and the investors ability to participate.
