REQUIRE PEOPLE WHO SELL INDEXED PRODUCTS TO OBTAIN A SECURITIES LICENSE AND BE AFFILIATED WITH A BROKER-DEALER.
The problem is how they are sold, not the products themselves. By making the reps that sell them be held accountable, namely for suitability, it will significantly reduce the abusive selling tactics that some reps have used, ultimately giving the rest of us and the product line a bad reputation. The problem is that the only exam currently required to be able to sell these products may as well be a 'color-by-number' placemat at Friendly's.

DO NOT MAKE THEM REGISTER AS SECURITIES. It is like trying to fit a circle into a square and doesn't make any sense. By making them register as securities you may as well just make them illegal altogether because the filing requirements will eat up all the benefits that are currently available to investors.
