No matter what decision SEC would make regarding the uptick rule the short-sellers should be able to get 'market order' fills at least twice a day: in the morning at MOO price and in the evening at MOC price. So MOO and MOC orders have to be exempt from the uptick rule.
That is important specifically for those investors who use short positions as hedge.
