The mechanics and outcomes of the original uptick rule are well understood and fuctioned effectively. Replicating that retuns us to a level, predictable playing field.
In addition, enforcing the requirement to actually borrow the stock before shorting it is essential to market order. Otherwise short sellers are creating stocks and driving down the actual value of the company.
